‍1. GENERAL CONDITIONS

1.1 Services

The company Taxi Radio Bruxellois SA is a call center, which means it connects a transporter (member) to a client.

Taxi Radio Bruxellois specializes in passenger transport and the fast road transport of letters and small parcels.

1.2 Pricing

Our prices are inclusive of VAT.

Any claim regarding the price must be submitted within eight days of the invoice date. The client remains responsible for payment, even if they instructed us to collect the transport fee from the recipient or any other third party. In addition to the transport price, all related and incidental expenses are added, including but not limited to storage, extra waiting time, detours, additional charges such as parking fees, tolls, etc., with no exceptions or reservations.

1.2.1 Payments

Our invoices are to be paid immediately and will automatically accrue interest at the legal rate plus 2%. In case of non-payment after a formal notice, an additional amount equal to 15% of the invoiced amount will be charged as a flat-rate compensation, with a minimum of €50 to cover commercial damage and administrative costs.

Please note that there are no fixed fees related to the business service. However, we charge 5%, 10%, or 15% management fees on the total amount of your invoice for all services related to the chosen commercial plan.

1.2.1.1 Payments through credit card

When a new credit card is added, a test transaction of €1.00 is automatically processed to validate the card. This transaction is then automatically refunded.

For each ride reservation paid via credit card, we authorize an amount equivalent to 20% of the fare, with a minimum of €5.00. This authorization serves, on one hand, to ensure there are sufficient funds on the card to complete the ride, and on the other hand, to cover any potential additional charges as mentioned in section 1.2 Price.

1.2.1.2 Payments through Apple Pay - Google Pay

For each ride reservation paid via Apple Pay or Google Pay, we authorize an amount equivalent to 20% of the fare, with a minimum of €5.00. This authorization serves, on one hand, to ensure there are sufficient funds on the card to complete the ride, and on the other hand, to cover any potential additional charges as mentioned in section 1.2 Price.

1.2.1.3 New Taxi Legislation

Since the new ordinance of October 21, a new taxi ordinance is in effect, available here.

Article 8. Specific Tariff Elements for Services Provided by Reservation

§ 1. For station-based taxi services provided by reservation and for street taxis, excluding luxury services referred to in Article 9, the minimum tariffs are as follows:

1° The pickup fee for the passenger is set at €1.50;

2° The price per minute is set at €0.40 per minute started;

3° The price per kilometer is set at €1.50 per kilometer;

4° The minimum fare for the ride is set at €8.

§ 2. The maximum tariffs are capped at 200% of the tariffs specified in § 1, 1°, 2°, and 3°.

1.2.1.4 Parking Fees at Airports

For pickups or drop-offs at airports, we apply parking fees in addition to the fare. These fees vary depending on the total waiting time of the driver at the airport.

1.2.2 Special Conditions Regarding the Client’s Absence at the Scheduled Pickup Time and Location.

Whether it is the client or the recipient, in case of the client’s absence at the pickup address, either at the time of booking for a pre-booked ride or at the time of the taxi’s arrival at the address for an immediate booking, the driver will wait free of charge for a certain period of time depending on the location and the chosen service (see the table below), unless there are specific contractual conditions. After this waiting period expires, the driver is authorized to leave and declare the client’s absence. Cancellation fees related to this absence may then be charged to the client by Taxis Verts, especially for rides paid via a credit card registered in the Taxis Verts mobile application. These fees are intended to compensate the driver for the journey they made.

1.2.2.1. Cancellation inside the Brussels Activity Zone

If the pickup takes place within our Brussels Activity Zone (see map below, excluding Brussels National Airport [BRU]), and if the driver is still on his way, the following fees will apply based on two conditions. The first condition is how long the driver has been on the way to the pickup location. The second condition is the estimated arrival time of the driver at the pickup location. If both conditions are met, cancellation fees will be applied.

If the driver is already at the pickup location and the client is not there, the driver may cancel the booking after the free waiting time, depending on the chosen service. The waiting time will be added to the above-mentioned fees when the booking is canceled.

1.2.2.2. Cancellation outside the Brussels Activity Zone

If the pickup is located outside the Brussels Activity Zone (see map below), approach fees will apply if the driver has been on the way for at least three minutes and has not yet arrived at the pickup location, depending on whether it is an ASAP or pre-booked ride. The amount of these fees is a percentage of the total approach fee, which corresponds to the total distance between the center of the Brussels Activity Zone and the pickup location, multiplied by the approach fee based on the service. This percentage is based on the time the driver has already traveled compared to the total time they would have had to travel to reach the pickup location.

If the driver is already at the pickup location and the client is not there, the driver may cancel the booking after the free waiting time, depending on the chosen service. The waiting time will be added to the above-mentioned fees when the booking is canceled.

1.2.2.3. Cancellation Fees at Brussels National Airport (BRU)

Separate fees apply for cancellations at Brussels National Airport. These fees are applied as soon as the driver is on his way to the pickup location:

In case of a dispute regarding this absence, the client can contact the Taxis Verts customer service, which will review the eligibility of the request.

1.2.3 Special Conditions for Guaranteed Fixed Prices

The estimated fare for the ride is shown by the mobile app before the booking as a price range. This estimate corresponds to normal traffic conditions and does not account for any unforeseen factors that could significantly increase the duration of the ride. It does not, under any circumstances, constitute a commitment from Taxis Verts.

To avoid these uncertainties, Taxis Verts offers a service called "guaranteed fixed prices," which allows you to benefit from a guaranteed price. By accepting the use of the "guaranteed fixed price" service, you agree to the proposed price, with Taxis Verts handling any potential difference between the fixed price and the meter price as part of its reservation center service.

The guaranteed fixed price will not apply in the following cases:

  • Driver waiting for more than 2 minutes before the pickup.
  • Additional waiting time requested during the ride.
  • Change of destination requested from the driver during the ride.
  • Detour requested from the driver during the ride.

1.2.4 Special Conditions for Our Taxi Vouchers and Parcels

The debit order forms for the vouchers are solely intended to pay the driver for taxi fares as well as the transport of parcels or mail that have been requested from us. They can never be used for loans, and no change can be given upon their submission. The mere inscription of the amounts to be debited is sufficient to validate the order, and the order does not necessarily need to be signed. It can be used by any bearer. The affiliate remains responsible, even in the case of loss or theft, for the use of the vouchers entrusted to them. Voucher statements are payable in full upon receipt, regardless of the amounts or payment periods. New voucher booklets can only be issued after payment of outstanding statements, and we reserve the right to assess the quantity to be issued without having to provide a reason. The deposited guarantee, which does not accrue interest, is never applied to settle statements, except in the case of cancellation, which immediately requires the return of any unused voucher forms. T.R.B. reserves the right to terminate the affiliation at any time without giving a reason, but will refund the guarantee or its balance in the case of non-payment. If the affiliation is terminated, the affiliate agrees not only to stop using any vouchers still in their possession but also to return them immediately to T.R.B. via registered mail. T.R.B. has the right to charge a fee of 2.5% of the statement amounts, with a minimum flat fee of €15 for billing costs.

1.2.5 Special Conditions for the Transport of Goods

1.2.5.0 Definition

Transport of Goods: Any item that complies with these terms. The transport of goods differs from passenger transport, as it requires a different type of vehicle, service, and VAT.

Parcel: Any item being transported, regardless of its nature, form, or weight, in compliance with the list authorized by these terms.

Client: A client is any legal entity or individual who places an order with our services.

1.2.5.1 Modality

Each transport of goods (hereinafter referred to as "Parcel") entrusted to our services must be labeled in a legible manner by the Client and include the complete contact details of both the sender and the recipient. The labeling must be done on each parcel individually.

The contents of the parcels must be packaged and protected by the Client in a way that ensures they can withstand normal handling and transport operations, considering their nature. The client agrees that the contents of the parcels will not be checked by our drivers at the time of pickup and cannot be contested regarding their condition upon delivery, except in the case of a parcel that is visibly and heavily damaged. The client waives the right to claim any damages for a damaged parcel content.

It is strictly prohibited to transport certain items in the parcels, as listed in Article 1.2.5.3 of these terms. The client is informed of this and will be solely responsible for the consequences in the case of non-compliance.

1.2.5.2 Responsibility

The responsibility of Taxis Verts is limited to finding a delivery driver or, if necessary, informing the client within a reasonable time that no driver could be found. Taxis Verts shall not be held responsible for any damage to and/or loss of goods or for any damage caused by the goods.

When a CMR Convention applies (at the client’s express request), the maximum compensation due by our company in case of liability will be 8.33 D.T.S per kilogram of missing or damaged gross weight. No compensation will be due for any damage that may be suffered due to unavailability and/or loss of customers and/or for any indirect damage.

1.2.5.3 Prohibited Goods for Transport

a. Our services may under no circumstances be used to transport hazardous goods (as defined in the applicable regulations for the transport of dangerous goods, including the ADR conventions, CMR, IMDG code) and other goods for which a permit is required.

b. It is specifically prohibited to transport the following items (non-exhaustive list) through our services:

  • Illicit products such as drugs, narcotics, and psychotropic substances;
  • Items, writings, or substances in general whose import, export, production, circulation, distribution, use, possession, sale, or transport are prohibited by law;
  • Items that, due to their shape, nature, or packaging, may pose a danger to individuals or may damage or soil other parcels, the delivery equipment, or goods (including parcels) belonging to third parties;
  • Chemical products, explosives, flammable or radioactive materials, infectious substances, solid carbon dioxide (dry ice), or other substances that may pose a danger;
  • Infectious materials, live animals (except injured birds transported in a perforated cardboard box), deceased animals, or parasites;
  • Items with external markings that are contrary to public order or good morals;
  • Weapons, essential components of weapons and ammunition, replica weapons, knives, swords, daggers, etc.;
  • Pressurized gases, toxic or corrosive substances, fuels, and organic peroxides.

c. Fresh Products

The transport of fresh products is only possible if the legal storage temperatures for refrigerated food items or frozen products are respected and guaranteed. This can be done either in a refrigerated vehicle or, if unavailable, in refrigerated boxes, insulated bags/containers containing cooling blocks, etc.

If a refrigerated vehicle is not available, the Client will be informed.

If the client still wishes to transport food items through our services, they must provide the parcels using refrigerated boxes, insulated bags/containers containing cooling blocks, and ensure that temperature monitoring is possible at all times.

Storage Temperatures:

  • For the Hot Chain, the minimum safe temperature is 60°C.
  • For the Cold Chain, the maximum safe temperature is 7°C.

The client is solely responsible for maintaining the hot and/or cold chain and for complying with the AFSSA (Federal Agency for the Safety of the Food Chain) regulations. Taxis Verts accepts no liability in the event of an inspection or deterioration of goods transported due to the client's negligence.

d. The client is responsible for all consequences and damages incurred by Taxis Verts, the Delivery Driver, or third parties due to non-compliance with these General Terms and Conditions and applicable regulations, even if they had informed Taxis Verts and the Delivery Driver of the nature of the Goods. Taxis Verts disclaims any liability related to the nature of the Goods. The Requester expressly acknowledges being aware of this exclusion of liability and accepts it.

1.2.5.4 Cancellation Fees by the Client

Whether it is the client or the recipient, in case of the client’s absence at the pickup address, either at the time of booking for a pre-booked ride or at the time of the taxi’s arrival at the address for an immediate booking, the driver will wait free of charge for a certain period of time depending on the location and the chosen service (see the table below), unless there are specific contractual conditions. After this waiting period expires, the driver is authorized to leave and declare the client’s absence. Cancellation fees related to this absence may then be charged to the client by Taxis Verts, especially for rides paid via a credit card registered in the Taxis Verts mobile application. These fees are intended to compensate the driver for the journey they made.

  1. Cancellation inside the Brussels 19 municipalities.

See table hereunder for cancellation fees applied depending on the service.

i. For DAY services, cancellation fees are applied if the driver is on the way for at least 10 minutes and is 5 minutes from the pickup location.

ii. For DIRECT services, cancellation fees are applied if the driver is on the way for at least 5 minutes and is 5 minutes from the pickup location.

iii. For FOURGON and HAYON services, if booking is immediate, then cancellation fees are applied as soon as the driver is on way, if the booking is scheduled, then cancellation fees are applied if booking is cancelled 60 minutes before the pickup time.

If the driver is already at the pickup location and the client is not there, the driver may cancel the booking after the free waiting time, depending on the chosen service. The waiting time will be added to the above-mentioned fees when the booking is canceled.

  1. Cancellation outside the Brussels 19 municipalities.

If the pickup is located outside the Brussels 19 municipalities, approach fees will be used as a basis to the cancellation fees whether it is an ASAP or pre-booked ride. The amount of these fees is a percentage of the total approach fee, which corresponds to the total distance between the center of Brussels and the pickup location, multiplied by the approach fee based on the service. This percentage is based on the time the driver has already traveled compared to the total time they would have had to travel to reach the pickup location, with a minimum of 50% of the approach fee.

If the driver is already at the pickup location and the client is not there, the driver may cancel the booking after the free waiting time, depending on the chosen service. The waiting time will be added to the above-mentioned fees when the booking is canceled.

  1. If the driver already has the parcel on board: the cancellation fee is the fare price (including waiting time if applicable) plus 50%.
  1. If delivery is impossible at the destination due to the client (absence, incorrect or inaccessible address, etc.) and the parcel must be returned to the pickup point: the cancellation fee is the fare price (including waiting time if applicable) plus 50%.

1.2.5.5 Complaints

The client can submit a complaint exclusively by email to the address cc@taxis.be.

Taxis Verts makes every effort to meet its deadlines and commitments. However, the Company cannot be held responsible for any delays or failure to meet deadlines.

If a client has ordered an additional paid option, and the option could not be delivered, the client may request a refund by email within a reasonable period of 5 working days from the completion of the ride.

If a client orders a direct delivery that could not be completed within a reasonable time due to unforeseen circumstances (e.g., weather conditions, traffic conditions, etc.):

If the goods are non-perishable: the client will only pay the delivery fee for the day.

If the goods are perishable: the goods will be refunded up to the amount of the CMR insurance, provided that the client informed Taxis Verts of the nature of the goods being transported at the time of the booking, in accordance with the provisions of articles 1.2.5.1 and 1.2.5.2.

1.2.5.7 Jurisdiction Clause

Any dispute will be subject to the exclusive jurisdiction of the courts in Brussels, French-speaking chambers.

If the client is a company, only the Commercial Court shall have jurisdiction. Belgian law shall apply exclusively.

1.3 Extra-contractual Responsibility

Unless otherwise required by mandatory law, each party waives the right to bring a claim for extracontractual liability against the other party and/or its auxiliaries (an auxiliary is defined as any individual or legal entity appointed by a Party, the debtor of a contractual obligation, to carry out all or part of that obligation, whether the obligation is carried out for their own account and in their name, or for the account and in the name of the debtor. This includes: employees, subcontractors, service providers, directors (whether de jure or de facto), representatives, independent contractors, and others). The auxiliaries of each party are third-party beneficiaries of this provision. To the extent necessary, the parties confirm that Article 18 of the Law of July 3, 1978 remains applicable concerning the actions of the worker.

2. GENERAL TERMS AND CONDITIONS OF RESERVATIONS

A prebooked taxi request consists of the registration by the TRB of this request, including the client's contact details, within a timeframe prior to the time of the journey. This is not the reservation of an identified taxi but a priority taxi search programmed by the company to be initiated shortly before the scheduled pickup time. The client's request is thus 'stored' in our central computer, and approximately 15 minutes before the pickup time communicated by the client, the dispatching system selects from among the taxis closest to the client's address a driver meeting the requested characteristics and then transmits to them the previously recorded contact details of the client to be picked up. In certain exceptional situations, due to external circumstances (strikes, heavy peak-hour traffic, weather conditions such as rain, snow, etc.), difficulties may arise, at the scheduled dispatch time, in finding an available taxi in the requested area. An unexpected complication may also prevent the driver from accessing the pickup location within the scheduled time. TRB shall under no circumstances be held liable for any potential delays that may occur, or a fortiori for their indirect consequences.

3. PRIVACY POLICY

Taxi Radio Bruxellois SA is committed to protecting the privacy of all visitors who use its services, as well as visitors who access its services through one of its mobile applications, Taxis Verts and Collecto. Please read the privacy policy below, which explains how we use and protect your information. 

By consulting and ordering services on this application, you agree to the collection, use, and transfer of your information in accordance with this policy.

3.1 Information We Collect From You

3.1.1 When you create or modify your account on one of our applications, place a taxi order through the application, contact customer support, or more generally when you communicate with us, you may be asked to provide information about yourself, including your name(s), phone number, email address, and postal address. We may also collect information relating to your use of the application and information about you from the emails or letters you send to us.

3.1.2 When accessing Taxis Verts information and services via mobile digital means such as (non-exhaustive list) a mobile phone, tablet, or other devices/technologies like mobile applications, the collection and use of data by Taxis Verts or Collecto mentioned in this privacy policy also apply. We may collect technical information from your mobile device or your use of our services via a mobile device, such as location data and characteristics and operating data of your device, your operator/operating system, including device and connection type, and IP address.

Contact Directory: If you grant permission to access your phone contacts, sharing information related to the addresses in your mobile device's directory is supported.

Unless you have chosen to remain anonymous through your device or platform settings, we may automatically collect and use this information if you use the service through your mobile device(s).

3.2 Use of Your Information

3.2.1 Your information enables us to provide you with access to the application and to supply the services you have requested. It also allows us to contact you when necessary regarding our services. We will also use and analyze the information we collect to administer, support, improve, and develop our business, for other purposes (statistical or analytical), and to help us prevent fraud. Where applicable, now and in the future, you may express your preferences regarding the use of your data in accordance with the provisions of this privacy policy.

3.2.2 We may use your information to contact you to request your opinion on our services and to notify you of important changes or developments to our application or services.

3.3 Disclosure of Your Information

3.3.1 The information you provide to us is transferred to and stored on our servers.

3.3.2 We may share the information we collect about you at the time of collection or sharing, including in the following ways:

  • With Drivers to enable them to provide the Services you request. For example, we share your name and pickup and/or drop-off points with Drivers;
  • In response to a request for information by a competent authority if we believe that disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal procedure;
  • With law enforcement, government agencies, or other third parties if we believe your actions are inconsistent with our User agreements, Terms of Service, policies, or to protect the rights, property, or safety of Taxi Radio Bruxellois SA or others;

3.4 Security and Data Retention

3.4.1 We take measures to protect your information from unauthorized access and against unlawful use, accidental loss, destruction, and damage. We will retain your information for a reasonable period or for as long as required by law.

3.4.2 Unfortunately, the transmission of information via the Internet is not completely secure. Although we take all necessary steps to protect your information, we cannot guarantee the security of your data transmitted to the application; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

3.5 Right to Access, Rectify, or Object

In accordance with the law of December 8, 1992, you have the right to access, rectify, object to, or update the personal data collected concerning you by sending us an email to the following address: info@taxis.be

3.6 Changes to Our Privacy Policy

Any changes to our privacy policy will be posted on the application and, where appropriate, communicated by email.
